The Party Wall etc. Act 1996 influences works to a Party Wall, Party Fence Wall (Typically a brick garden wall astride the boundary) or Party structure (typically a floor that separates flats).
Perhaps less obvious is that The Party Wall Act also deals with new construction works up to the boundary, across the boundary (as a new Party Wall) and for adjacent excavation within 3m and 6m of an adjoining owner’s foundations.
Notice(s) can be served by any person however they must be served strictly in accordance with the Act in order not to be invalid which could otherwise invite legal action.
Party Wall Notices must be served at least 1 month or 2 months in advance of commencement of work depending on the type of planned construction works and this should be considered within any construction programme.
